Fair Hearings — Appeal a Benefits Decision

Complaints & Appeals
Request a Fair Hearing

Was this information right?

What this program is

A Fair Hearing is a chance for you to tell an Administrative Law Judge from the New York State Office of Temporary and Disability Assistance, Office of Administrative Hearings, why you think a decision about your case made by a local social services agency is wrong. OTDA will then issue a written decision which will state whether the local agency's decision was right or wrong. The written decision may order the local agency to correct your case.

Who can get it

Anyone who believes a local social services agency's decision about their case is wrong can request a Fair Hearing.

Heads up

  • If you received a Fair Hearing decision in your favor and the local agency has not done what the decision ordered, you can submit a Compliance Complaint to the same office.

How to apply

Requests for hearings can be completed online, by U.S. Mail, by telephone, or by fax. Call 1-518-474-8781 or toll free 1-800-342-3334.
